Fit for purpose?
Here at Tutti Audio we pride ourselves on our professionalism, knowledge and expertise. Indeed, we go that extra mile to ensure that all our customers get honest open advice, care and value for money.
As some of our products and services relate to pre-owned, vintage audio equipment (otherwise referred to as electrical goods), we feel it important for your own benefit, to clarify what your statutory rights are in this respect.
Although there is no legal requirement we are aware of for a retailer to offer a warranty period on second hand electrical goods, we do. In fact, we provide a 6 to 12 months parts and labour guarantee, over and above your statutory rights.
Importantly, we pay serious attention to the equipment’s electrical safety as vintage record players and hi-fi systems were produced many years prior to modern day practices and European harmonised norms. In this case the Electrical Equipment Safety Regulations 1994 (Low Voltage Directive).
Indeed, on browsing the Internet, it’s not difficult to find traders selling similar second hand equipment devoid of any warranties or cognizance with respect to electrical safety legislation.
Here then as we understand it are your statutory rights in a nutshell…
The Sale of Goods Act 1979, under which traders must sell goods that are as described and of satisfactory quality, applies to second-hand goods just as it does to new ones.
This is also the case when buying from any standalone official online retailer irrespective of whether the goods are second-hand or new. In fact, in this case, another layer of protection will apply, known as Distance Selling Regulations.
As you haven’t been able to see the physical goods prior to purchase, this law states that you have a seven-day cooling off period, starting from the day after delivery in which to change your mind. This means you can get a full refund without having to give a reason, regardless of whether the goods are second-hand or new.
When you make a second hand or new purchase from a retailer’s shop/premises you can exercise exactly the same rights under the Sales of Goods Act. This means that if the item is not fit for purpose or is faulty, you can demand a refund.
However, if you merely change your mind the retailer is under no legal obligation to provide a refund or even a return.
Whether new or second hand, all electrical goods sold must meet the Electrical Equipment Safety Regulations 1994 (Low Voltage Directive).
